Question
Is there an extension of the 2/5/10 period specifically relating to an item to which repairs have been made under your program?
For instance, if there is a defect in a hardwood floor, say some discolouration in a very small area:
-
Does the entire floor have to be replaced?
-
Do you have specific standards which apply to the many different scenarios that could come up [involving the extent of the repair to be implemented]?
-
Once the repairs have been made, does the homeowner have more than the original 2 year warranty on his or her hardwood floor?
Response
Any repairs completed are guaranteed for 1 year from the date of repair (or until the end of the applicable warranty period), whichever is latter. Flooring falls within the first year portion of the warranty only.
In regards to repairs in general, if the repaired area matches the surrounding area, total replacement is not required. If a dispute exists between an owner and a builder in regards to a match, we can inspect and decide if it is acceptable. If, in the case of floor coverings, an acceptable match cannot be obtained, then entire replacement would be required.
Travelers Guarantee will, through a claims adjustment inspection, determine what a reasonable repair is, independant of both the homeowner's and builder's opinions. Our standards are based on our own labour and material standards, the building code, and industry standards. If an owner is not satisfied with our decision, through the Act, they can proceed to mediation, and, ultimately, to court.
